EU-Compliant Right of Withdrawal & Return Policy

If you are a consumer residing within the European Union (EU) or European Economic Area (EEA), you have the legal right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire, or a third party indicated by you (other than the carrier) acquires physical possession of the goods.

1. How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal, you must inform us of your decision to cancel this contract by a clear statement. You can do this in any of the following ways:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

2. Effects of Withdrawal (Refunds)
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us).

We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied. We may withhold reimbursement until we have received the goods back.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction.

3. Returning the Goods
You shall send back the goods no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

• Return Shipping Costs:
  You will be responsible for the cost of return shipping.
• Consumer Liability:
  You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods (e.g., trying on a piece of clothing is permitted, but wearing it for a week is not).
  

4. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to the following types of contracts:

• The supply of goods made to the consumer’s specifications or clearly personalized (custom items).
• The supply of goods which are liable to deteriorate or expire rapidly (perishable goods).

5. Non-Refundable Third-Party Fees
Please note that we ship packages Delivered Duty Unpaid (DDU). As the importer of record, you are solely responsible for any import VAT, customs duties, and carrier administrative/handling fees assessed upon entry into the EU.

• No Merchant Reimbursement: Garrity Tools does not collect, receive, or hold these third-party fees. Consequently, we cannot refund any customs duties, import VAT, or courier handling charges if you choose to return your order.
• How to Reclaim Fees: To request a refund for import VAT or carrier administrative fees paid at the time of delivery, you must apply directly to your local customs authority or the courier service that handled your delivery.
• EU Flat Customs Duty Notice: Please be aware that under EU regulations, the flat €3 customs duty applied to imports under €150 is legally non-refundable by tax authorities unless the item arrived damaged or faulty.
